Alpiq wins first instance in tax dispute with Romanian tax authority

Lausanne, 19 October 2021 – The Romanian administrative court of first instance has ruled in favour of Alpiq Energy SE, Prague, in the tax dispute over value-added taxes and corporate income taxes that has been in progress since 2017.

Following a tax audit for the period from 2010 to 2014, the losing Romanian tax authority ANAF (Agenția Națională de Administrare Fiscală) had sought to claim value-added taxes, corporate income taxes, interest and penalties amounting to approximately CHF 130 million from Alpiq Energy SE. In its decision dated 19 October 2021, the court has now followed Alpiq Energy SE’s reasoning and overturned ANAF’s tax assessment as illegal. The decision is not yet legally binding and can be appealed by ANAF before the court of second instance.
